Kentucky environmental attorney Sanders says USACE suspending Nationwide Permit 21 for Appalachian mining sites.

The U.S. Army Corps of Engineers (Corps) has suspended the use of Nationwide Permit 21 (NWP 21) in the Appalachian region of Kentucky, Ohio, Pennsylvania, Tennessee, Virginia and West Virginia, and announced this decision in the June 18, 2010, edition of the Federal Register.  FINAL PN for Districts announcing NWP 21 decision.pdf

The permit, which allows a coal mine to make minor impacts on streams and water sheds without the heavier scrutiny of an individual permit. The agency said the suspension is effective immediately in Kentucky, Ohio, Pennsylvania, Tennessee, Virginia and West Virginia.
