			<content:encoded><![CDATA[<div class='snap_preview'><br /><p class="MsoNormal" style="margin:0;"><span style="font-size:small;font-family:Calibri;">Folks living in and around Toledo, Ohio will be glad to know that U.S. EPA and the Ottawa River Group agreed to a $43 million cleanup of contaminated sediment in the Ottawa River. <span> </span>Costs will be equally shared between EPA, using funds provided by the Great Lakes Legacy Act, and the local sponsors. <span> </span>The Ottawa River Group is a partnership of the city of Toledo and businesses along the river, including E.I. duPont, Honeywell, Chrysler, Allied Waste North America, Illinois Toolworks, United Technologies and GenCorp.</p>
<p>Beginning this summer, about 270,000 cubic yards of sediment contaminated with polychlorinated biphenyls or PCBs, polycyclic aromatic hydrocarbons or PAHs, and metals will be dredged from a 5.6-mile stretch of the river. The project is expected to be completed in about two years. <span> </span>Contamination in the sediment of the Ottawa River is a leading cause of state advisories against eating certain fish from the river and Maumee Bay. </span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:small;font-family:Calibri;"> </span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:small;font-family:Calibri;">The cleanup will reduce the mass of PCBs entering Lake Erie. Dredged sediment contaminated with high levels of PCBs will be sent to a facility designed and permitted to accept this type of waste. Remaining sediment will likely go to Toledo&#8217;s Hoffman Road landfill. <span> </span>Although discharges of toxic chemicals to the Great Lakes have been reduced in the last 30 years, contaminants persist in the sediment of some rivers, harbors and bays as a &#8220;legacy&#8221; of urbanization and industrial activity.</p>
<p>Five Legacy Act cleanups have been completed. More than 900,000 cubic yards of sediment have been cleaned up, removing 1.7 million pounds of contaminants. The total cost of the cleanups was $97 million, with $53 million coming from Great Lakes Legacy Act funds and $44 million from nonfederal sources. Key to the success of the projects has been the strong partnerships that have developed between EPA and other federal, state, local and private entities.</p>

<p class="MsoNormal" style="margin:0 0 10pt;"><span style="font-size:small;font-family:Calibri;">As Members of the Senate Committee on Environment and Public Works (&#8220;the Committee&#8221;), we are writing to request information about the allegedly forced resignation of Mary Gade as the Environmental Protection Agency&#8217;s (EPA) Region 5 Administrator. News outlets have reported that individuals in your office forced Ms. Gade to resign after she decided to protect public health by forcing the Dow Chemical Corporation to clean up a heavily-contaminated Superfund site. </span></p>
<p class="MsoNormal" style="margin:0 0 10pt;"><span style="font-size:small;font-family:Calibri;">We are writing to request from you full information of the circumstances surrounding Ms. Gade&#8217;s departure. As you know, Congress and the American people expect EPA to enforce vigorously our public health protections &#8211; and to preserve the integrity of the enforcement program by excluding politics from such activities. We are troubled by reports suggesting that there was a link between her efforts to assure an aggressive cleanup by Dow and her allegedly forced departure, and are seeking answers from you to key questions. </span></p>
<p class="MsoNormal" style="margin:0 0 10pt;"><span style="font-size:small;font-family:Calibri;">A May 2 story in the Chicago Tribune states that Ms. Gade: </span></p>
<p class="MsoNormal" style="margin:0 0 10pt;"><span style="font-size:small;font-family:Calibri;">has been locked in a heated dispute with Dow about long-delayed plans to clean up dioxin-saturated soil and sediment that extends 50 miles beyond its Midland, Mich., plant into Saginaw Bay and Lake Huron. The company dumped the highly toxic and persistent chemical into local rivers for most of the last century. </span></p>
<p class="MsoNormal" style="margin:0 0 10pt;"><span style="font-size:small;font-family:Calibri;">The news report also states that Ms. Gade: </span></p>
<p class="MsoNormal" style="margin:0 0 10pt;"><span style="font-size:small;font-family:Calibri;">invoked emergency powers last summer to order the company to remove three hotspots of dioxin near its Midland headquarters. She demanded more dredging in November, when it was revealed that dioxin levels along a park in Saginaw were 1.6 million parts per trillion, the highest amount ever found in the U.S. Dow then sought to cut a deal on a more comprehensive cleanup. But Gade ended the negotiations in January, saying Dow was refusing to take action necessary to protect public health and wildlife. Dow responded by appealing to officials in Washington&#8230;. </span></p>
<p class="MsoNormal" style="margin:0 0 10pt;"><span style="font-size:small;font-family:Calibri;">The article says that Ms. Gade: </span></p>
<p class="MsoNormal" style="margin:0 0 10pt;"><span style="font-size:small;font-family:Calibri;">drew fire from officials in Washington after she sent contractors to test soil in a Saginaw neighborhood where Dow had found high dioxin levels. The levels in one Saginaw yard were nearly six times higher than the federal cleanup standard, and 65 times higher than what Michigan considers acceptable. </span></p>
<p class="MsoNormal" style="margin:0 0 10pt;"><span style="font-size:small;font-family:Calibri;">According to media reports, she received &#8220;high marks&#8221; from EPA officials in her last performance review. However, we are also aware of more recent suggestions that there may have been other circumstances that contributed to her leaving; we are seeking answers to get to the bottom of this issue. </span></p>
<p class="MsoNormal" style="margin:0 0 10pt;"><span style="font-size:small;font-family:Calibri;">Against the backdrop of allegations of political intervention in EPA decision-making that have been aired at recent hearings before this Committee, as well as similar allegations that we have heard from EPA staff and seen widely reported in the media, it is important for there to be a full explanation of the circumstances surrounding Ms. Gade&#8217;s allegedly forced resignation. Under the Committee&#8217;s due and proper authority to inquire and investigate into the administration of environmental laws, we ask that you furnish responses to the following questions (attached) no later than May 23, 2008, unless otherwise noted. Gade, over her handling of a cleanup of dioxin released by Dow Chemical.<span>  The Bush Adminstration appointed </span>Ms. <span>Gade as Regional Administrator of EPA Region 5 in October 2006.  In that role, she oversees federal environmental programs in the Great Lakes states of Illinois, Indiana, Michigan, Minnesota, Ohio and Wisconsin. </span></span></span></p>
<p class="MsoNormal" style="margin:12pt 0 0;"><span><span style="font-size:small;"><span style="font-family:Times New Roman;">Ms. Gade is an environmental attorney with more than 20 years of experience in environmental regulation and enforcement at the federal and state levels, as well as extensive private sector experience. Since 1999, she had been a partner in the national environmental practice group of Sonnenschein, Nath &amp; Rosenthal LLP in Chicago. She had previously served as director of Illinois EPA under Gov. Jim Edgar. During her eight years there, she was a co-founder of the national Environmental Council of States. Before her state tenure, Ms. Gade had a career at EPA with senior management positions in key areas such as emergency response, Superfund cleanup and pollution prevention. At EPA headquarters in Washington, D.C., she served as deputy assistant administrator of the Office of Solid Waste and Emergency Response. She previously held two senior positions at EPA Region 5 – associate division director for Superfund, and deputy director of the Waste Management Division.<span>  </span>Ms. Gade holds a bachelor’s degree from the University of Wisconsin, and a J.D. from Washington University School of Law.</span></span></span></p>
